Terms of sale

This English version is provided for convenience. The French version prevails.

1. Purpose

These terms cover the use of the Samy software and the subscription to its services. By creating an account or subscribing, you accept them.

3. The service

Samy is software for Windows 10 and 11 that helps you organize your workday: a morning ritual, the tunnel, an evening close, quick capture, and an assistant you can type or talk to. The assistant, sorting and voice go through our servers: they need an account and an internet connection.

4. Account

You sign up with your email address or your Google account. The account is personal. You are responsible for access to your mailbox and your computer.

5. Free trial

Every new account gets a 14-day free trial, with no card needed and an allowance for the assistant. When the trial ends, the assistant stops unless you subscribe. Your data stays on your computer and quick capture keeps working.

6. Price and payment

The subscription costs €15, VAT included, per month. You pay by card through Stripe, when you subscribe and then every month on the same date. Businesses based in another EU country can enter their VAT number at checkout (reverse charge). Your invoices are in the customer portal, which you open from Samy.

The subscription includes a monthly allowance for the assistant, sized for normal daily use. Samy shows how much is used. If you reach it, the assistant pauses until the start of the next month. The rest of the app keeps working.

We may change the price. If you subscribe, we’ll email you at least 30 days before. The new price applies from the next renewal, and you can cancel before then.

7. Term and cancellation

The subscription is monthly, with no commitment, and renews automatically every month. You can cancel anytime from Samy (Manage subscription). Cancellation takes effect at the end of the month already paid, and you keep access until then. The current month isn’t refunded, except under the right of withdrawal (section 8).

8. Right of withdrawal

If you are a consumer, you have 14 days from your first payment to withdraw, without giving a reason. Tell us by email at hello@bonjoursamy.com, for example with the template below. We refund you in full within 14 days, with the same payment method, and the subscription stops.

I hereby give notice that I withdraw from my contract for the Samy subscription, taken out on [date], in the name of [name], with the email address [account address].

9. Legal guarantees

You benefit from the legal guarantee of conformity for digital content and services under articles L224-25-12 and following of the French Consumer Code. If something is wrong, write to hello@bonjoursamy.com.

10. Availability and updates

We do our best to keep the service available at all times. It may be interrupted for maintenance or if a provider has an outage. Samy updates itself. Its features may change, without removing the core of what you pay for.

11. The assistant

Samy’s replies and suggestions are generated automatically and may contain mistakes. You alone decide how you organize your work. Every change Samy makes to your board can be undone. Avoid giving it sensitive data (health, bank details, passwords).

12. Fair use

You agree not to misuse the service: no reselling, no automated use to drain the allowance, no attempt to access systems or other people’s accounts, no unlawful content. For a serious breach, we may suspend the account after warning you, except in an emergency.

13. Liability

We are liable for direct damage caused by a failure to meet our obligations. We are not liable for force majeure, misuse of the service or a third party’s fault. For business customers, our liability is limited to the amounts paid in the last 12 months.

14. License and ownership

We grant you a personal, non-exclusive right to use Samy during the trial and the subscription. The software remains ours. Your board and your content remain yours.

16. Changes to these terms

If these terms change, we email subscribers at least 30 days before. If you disagree, you can cancel before they take effect.

17. Disputes

If something goes wrong, write to us first at hello@bonjoursamy.com and we’ll look for a solution with you.

These terms are governed by French law. For consumers, the competent court is the one set by law. For businesses, the courts of Grenoble.
